Stark Naked Cattery
I, Angel Roberson, owner operator of Stark Naked Cattery, received a non-refundable deposit of two hundred and fifty dollars (250.00) towards the purchase of a sphynx kitten. The total purchase price is __________. The remaining amount of ___________ is to be paid before buyer takes possession of the kitten.
*The kitten is being sold as a pet only. The kitten must be spay/neutered between seven months and nine months of age. The BUYER must show proof of the procedure from a licensed Veterinarian on or before ______, 200 or the buyer must dissolve ownership and return the kitten to Angel Roberson at the BUYER’S expense. *I, Angel Roberson, guarantee that the kitten is in good health at the time of delivery to buyer. Stark Naked Cattery urges the new owner to have the kitten examined by the new owners veterinarian by _______________ to confirm this kittens good health. BUYER agrees to isolate kitten from other animals in the household for one week or as otherwise advised by veterinarian. If kitten should die within 7days of purchase from an infectious disease and has not been exposed to other animals, SELLER agrees to replace kitten/cat with a kitten of equal quality within one year from date of death. Infectious disease diagnosis must be in writing and should be stated as cause of death on completed necropsy report from a licensed veterinarian. *If the kitten described above should die within a year of dated of purchase due to congenital or hereditary defect, the SELLER will replace the kitten/cat with another kitten/cat of equal or better quality at no cost to the BUYER. The SELLER must receive proof of defect in the form of a complete necropsy(autopsy) report by a licensed veterinarian. *Necropsy’s will be performed at BUYERS expense. BUYER OBLIGATIONS BUYER accepts the responsibility of caring for the cat/kitten and will provide properly for its welfare. BUYER agrees to keep the cat/kitten indoors at all times in a clean and pleasant environment, not caged, and with proper nutrition, health care (including yearly veterinarian examinations and vaccinations), companionship, and adequate space for exercise. The cat/kitten is only allowed outdoors while on a leash and while under close supervision. Due to the lack of fur, Sphynx are more easily chilled than some other breeds. BUYER agrees to provide a suitable warm place for the cat/kitten at all times. BUYER understands that if the cat/kitten is found to be neglected or mistreated in any way SELLER shall have the unconditional right to reclaim the cat/kitten without refund of the purchase price. Neglect shall include, but is not limited to: lack of proper sanitary facilities, being caged, providing poor diet, and poor health. Mistreatment shall include, but is not limited to: lack of proper food, lack of proper medical care, lack of fresh water, and any form of physical abuse. BUYER agrees that the cat/kitten will NEVER be declawed and the adequate scratching posts and regular nail trimming will be provided. BUYER agrees that under NO circumstances with the cat/kitten ever be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar facility. Should BUYER not be able to keep the cat/kitten for any reason, including the incapacitation or death of the BUYER, the SELLER has the first option to buy the cat/kitten back or assist in finding a suitable new home for it. This remains in effect for the entire life of the cat/kitten. For the life of the kitten/cat, the BUYER agrees to inform SELLER of any change in contact information (address change, phone#, etc..) within 30 days of said change. NOTE: It is understood that degrees of hairlessness in Sphynx vary from cat to cat and that no Sphynx is completely hairless. It is understood that hormones, climate, and genetics play an important role in hairlessness and that even though a Sphynx kitten may be almost hairless when sold, it is possible that the kitten could develop some hair after being spayed/neutered or as it grows older. It is also impossible to guarantee that any Sphynx cat/kitten will not grow some hair at some point in the future. Any legal action which may arise under the terms of this contract will be brought in Clark County Neveda, USA. BUYER shall be liable for any court costs and related charges including attorney’s fees associated with SELLER enforcing the terms of this contract. In signing this document, BUYER acknowledges that he/she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State of Nevada shall be controlling. BUYER and SELLER agree to ALL of the above stated terms.
